Terms and conditions of reservation and renting apartments
General provisions
1. These terms and conditions determine the conditions for reserving and renting apartments. Making reservantion is tantamount to aceptation the terms and conditions. Reservations means conclusion of the contract.
2. Reservation

In order to book a service a client fills in a reservation form and sends it to the following e-mail address apartinfo@apartinfo.net . A reservation form concerns a particular apartment.

To confirm a reservation Apartinfo Sp.z.o.o. sends an e-mail to the client with The preliminary confirmation of the reservation and the information about the due sum, the payment date and the number of the bank account.

The reservation becomes effective when the reservation fee is credited on Apartinfo’s bank account (or other another bank account indicated by Apartinfo Sp.z.o.o.) .

Apartinfo sends to a client an e-mail with the final confirmation of reservation within 24 hours of crediting the deposit on Apartinfo’s bank account.

the final confirmation of reservation of an apartment and the reservation forms are the contract for renting the apartment, which comes into force providing that the payment for the services is made on time and in accordance with conditions specified herein.
3. Conditions of payment

Client pays 30% (50% - 06-24.06.2012) of the whole due sum as a deposit on a bank account provided in the preliminary confirmation of the reservation. The due sum has to be credited on Apartinfo’s account within 3 (three) days of receiving the preliminary confirmation of the reservation. Always at least 2 days before the first day of using the apartment.

If the deposit is credited on Apartinfo’s bank account after the period specified hereinabove, the reservation will not be made, unless Apartinfo makes the reservation despite the given situation.

The remaining part of the payment must be made in cash when tenants get the keys to the apartment and before they start to use it.

Only basic services: providing bedding and cleaning after the stay are included in the price.

A price for the service is a gross price and comprises 8% VAT.

A client can get a VAT invoice or a bill for the whole due sum, providing that a he or she will give all the necessary details on the arrival date.

To the costs of renting there is added a payment in the amount of PLN 80 on one-off basis. The payment is for the apartment’s cleaning and does not depend on the number of people and the length of stay.
4. Cancelation of reservation and prolonging the stay.

A client may cancel the reservation. A client promptly informs about the fact via an e-mail.

In the event of cancelation of the reservation, a client is not paid back 30% of the paid deposit.

If a client shortens his or her stay at an apartment, the money paid for the booked stay are not paid back.

A client may prolong his or her stay by making a next reservation at Apartinfo, providing that the apartment is available on the days a client asks for.
5. Responsibility

If providing the service as an agent in the reservation of the apartment turns out to be impossible and it is Apartinfo or a landlord’s fault then Apartinfo commits itself to make every effort to offer a service of a similar standard and on dates specified in the reservation form.

In the event when a client does not agree on providing a service of a similar standard, Apartinfo is obliged to pay back the deposit for the apartment.

Liability of Apartinfo for acting as an agent in booking, concluding a contract and in providing the service is limited to the amount of deposit in all cases. All claims connected with a failure to provide a service or providing it in an improper way should be submitted via Apartinfo.

Apartinfo is not responsible for difficulties in access to the reservation system which is a result of events outside the control of Apartinfo. An access to www.apartinfo.net service can be suspended during the period when technical and organizational faults are dealt with.

Lessee shall bear the sole responsibility for the common part.

Agent is not responsible for possessions left in the apartment, especially for its losing or damaging.

Agent shall bear responsible for Lessee getting injured in the apartment.
6. Term and conditions of renting an apartment.
A client using a service is obliged to obey the following rules:

An apartment is rented for 24 hours.

Apartinfo guarantees the conditions for an unrestricted stay at an apartment.

Number of people that can stay at an apartment is limited to the number of people provided on the internet service www.apartinfo.net and in the reservation made by a client. Declared in the reservation number of tenants can be changed provided that there are no more people than it is provided in an offer on the internet service www.apartinfo.net. If it is clearly stated in an offer it is possible for additional people to stay on additional beds providing that additional payment is made. If at the check out it turns out that the number of people staying at an apartment was bigger than the number declared in the reservation and Apartinfo does not know about it, Apartinfo has the right to charge a payment for an additional person or if there is no such an option Apartinfo will charge 30% of the whole sum of reservation.

Receipt of keys shall take place in the place and at the time indicated in the confirmation of reservation. The apartment’s keys cannot be make available to third parties. Apartinfo Sp. z o.o. can check the indentity of people who did not enter into the renting agreement and use the apartment’s keys.

A client is accommodated providing that

The remaining price for the service is paid,

Identity of a client is confirmed (an ID, a card of a permanent residence, a passport)

Paying a deposit which is specified in point 11

Children under 18 stay at an apartment only under supervision of an adult.

A client can use an apartment only as a place to live and must not sublet it.

A client is obliged to obey the norms of good life with neighbours and to keep the rented apartment in a proper condition. At the apartment there are quiet hours from 10 p.m. to 6 a.m. If quiet hours are disturbed and a representative of Apartinfo or an owner is called to an apartment by neighbours or by the Police, Apartinfo has the right to cancel the contract without the obligation to pay back the sum for renting an apartment.

The hotel day lasts from 3 p.m. on the arrival day to 10 a.m. on the departure day in the place and at the time specified in the confirmation of the reservation. Before the check-out in client’s presence the technical condition of an apartment and its fittings. A check-in and a check-out in an apartment takes place when an owner or his/her representative is present.

During the stay a client is obliged to obey the apartment’s regulations.

A client has financial liability for all the damages in the apartment or its fittings caused by him/her. Futhermore, a client is obliged to inform a representative of Apartinfo about all damages and faults promptly after the occurrence, regardless of the cause. A client has to pay for the damage before he/she before his/her last day of using the apartment. In order to secure fulfillment of this obligation Apartinfo reserves the right to take a deposit of PLN 200,00 when keys are given to a client. The deposit is paid back on the departure day providing that Apartinfo has no objection to the technical condition of the apartment or its fittings during the check-out. For every damage in an apartment caused by a client Apartinfo has the right to retain the whole deposit or its part, at least the sum which is estimated as a cost of repair.

A client is obliged to pay due attention to appropriate using water and gas valves and electric appliances. Because of fire control a client is not allowed to use any electrical devices which are not a part of the fittings. The exceptions are: a mobile phone charger, a power pack, a radio, a computer, an electric razor, a hairdryer.

Smoking in an apartment is banned unless it is allowed in a description of the apartment at www.apartinfo.net.

Apartinfo is not responsible for a loss or a damage of things brought to an apartment by a client. The same concerns clients’ cars or things left in them.

Apartinfo bears no responsibility for any inconveniences connected with power cuts, breaks in provision of gas or water, restoration works in the building where an apartment is, restoration works of an apartment’s fittings or faulty work of devices in an apartment that may occur during a client’s stay.

All additional information is provided on the behalf of Apartinfo by a person who confirms the reservation in the final confirmation of reservation.

The price provided at www.apartinfo.net includes:
-
Costs of water, gas, electricity used by a client during the stay, cost of waste disposal;

Providing clean towels and change of bedding (one set for the whole stay).

A licence for the Internet or satellite TV (if it is available in a particular apartment).

Pets’ stay at the apartment is only possible after the approval of the apartment’s owners. The apartment’s staff has the right to refuse the rest to stay at the apartment if they have taken pets without discussing the fact with the owners. On the premises dogs have to be kept on the lead all the time.

Personal details: By making a reservation at www.apartinfo.net a client hereby agrees to keep his/her personal detail in Apartinfo database. This date will be used only for making a reservation, making it easier to book an apartment next time and marketing purposes in accordance with the law of 29th August 1997 on protection of personal details. A person who makes the reservation has the access to one’s personal details and can update them. Apartinfo has the right to change the terms and conditions in any way, at any time. All issues not specified herein shall be governed by the provision of the Civil Code and relevant laws.

Apartinfo sp. z o.o. does not provide household detergents (including dishwasher’s tabs, soup, washing liquids, washing powder etc.)

The prices on www.apartinfo.net concerns the stay until the 31st of December 2012.
Definitions of terms used in the terms and conditions:
Price for the service means a payment for a service, called also a payment for renting,
The reservation form means a document which is an only form of the reservation or the cancelation of the reservation of renting an apartment, it is in an electronic version and it is available at www.apartinfo.net
An apartment means a holiday apartment described at www.apartinfo.net, which is a subject of the reservation.
The final confirmation of reservation means a form for acceptance of the reservation fee
The reservation means the right to use an apartment on conditions specified in the final confirmation of reservation and herein.
